Distribution d’Équipement et de Matériel d’Alarme DEMA SA (hereafter called DEMA SA)
Our terms and conditions are part of the mutual contractual obligations.
By placing his order, the buyer implicitly confirms that he has read and accepted our general terms and conditions.

PRICES
The prices indicated are net prices in Swiss Francs (CHF) without VAT, FOB Geneva without transport and packing charges. No discount is allowed on the amount of the invoice. Prices can be changed without prior notice. Prices on all batteries include TAE elimination taxes.

SHIPMENT
The delivery is considered accomplished once the goods have left our warehouse.
The risk of delivery and transport are the responsibility of the buyer.
Delivery costs are charged to the consignee and are made at his choice by Swiss Post, DHL or other transporters specified.
We do not carry any responsibility for compensation of claims for delivery delays or transport damages.
Claims can only be accepted within 8 days of receipt of the shipment.

INVOICES
Each shipment is covered by a separate invoice. For part shipments we apply the same price as we would for a global shipment.
Transport costs for the different shipments are invoiced.

PAYMENT TERMS
For clients with an established account, invoices are due within 30 days from invoice date. Clients without an established account are supplied against COD or prepayment.
By legal collection of overdue invoice we cancel credit previously granted on the account. Deliveries of pending orders and new orders will thereafter be made against prepayment.

WARRANTY AND RESPONSIBILITY
The warranty of the manufacturer is fully taken into consideration.
Bar codes or dates of expiration of the manufacturer determine the warranty. Otherwise the warranty period is 2 years from date of manufacturing, if no particular warranty period is mentioned.
Our warranty is limited to the repair or replacement of defective goods or reimbursement of the price invoiced for the goods, to be determined by us.
We decline all other responsibilities, such as costs of dismounting and remounting of products, caused directly or indirectly by a faulty product or due to an inappropriate application. Warranty is not applied for goods which are returned incomplete or which have been modified or dismantled or which have been used for another application as the one given for the product.

GENERAL TERMS AND CONDITIONS
Our general terms and conditions apply for orders placed with us and repeal the purchasing conditions of the buyer, unless a prior written agreement made by us.

TECHNICAL DATA AND PICTURES
Technical data and illustrations of our documentations and of our homepage shall be regarded as non-binding and can be revised or modified any times without prior notice.

RETENTION OF OWNERSHIP
We reserve the right of ownership of all goods sold until receipt of the complete payment of products invoiced.

RMA
Your return request must be completed using our RMA request form available here for each of the following cases:

1) Return for credit
DEMA reserves the right to issue a return offer in the form of a credit towards a future delivery.
A processing fee of CHF 30.- will be deducted from the value of your return.
Deductions may also be applied to the original value of the item(s).

Deductions in % on the original value and cumulative:
- Sealed on open cardboard: -5%
- Product not reseted: -5%
- Cardboard in poor condition: -10%
- Missing cardboard box: -15%
- Incomplete accessories: -15%
- Damaged item: -25%
- Delivered by Dema more than 3 months ago: % Prorata of the remaining warranty time

Each item will be tested and checked internally or by the manufacturer.
DEMA reserves the right to refuse a credit if the condition of the item(s) is not suitable for resale.

2) Return for exchange
Each item must be returned within 10 days after our RMA slip has been sent.
At the same time we will send you a replacement item in advance exchange which will generate an invoice.
The item(s) will then be tested and inspected internally or by the manufacturer.
- If it is found to be in perfect working order, or out of warranty, the item(s) will be returned to you and you will be invoiced within 30 days for the advanced exchange.
- If it is not functioning properly we will keep it and issue a credit note which will cancel the advanced exchange invoice.

3) Return for repair
Each item will be tested and checked internally or by the manufacturer.
- If it is under warranty we will repair it or replace it with an equivalent model
- If it is out of warranty we will send you a repair quotation
- If it turns out that your product works perfectly, or if you refuse the repair estimate, we will return it to you with a processing fee of CHF 50.-

INTELLECTUAL PROPERTY RIGHTS
DEMA SA is owner of the copyrights as well as the intellectual property rights of this website. No use or copy thereof can be made without our prior consent.

JUDICIAL JURSIDICTION
The Swiss law is applied for all disagreements.
